Ownership of property
158. - (1) An officer shall, on his appointment to the public service or at any time thereafter as required by the Government, declare in writing to the State Secretary through the Head of Department all property belonging to him, his spouse, or his children, or held by any person on his behalf or on behalf of his spouse or children. If such officer has no property, he shall report accordingly in writing.

(2) Where, after making a declaration under paragraph (1), an officer or his spouse or children acquires any property, either directly or indirectly, or disposes of any property acquired by him or them, he shall declare immediately such acquisition or disposal of property to the State Secretary through the Head of Department, or if he is himself the Head of Department, he shall make such declaration directly to the State Secretary.

(3) Where an officer or his spouse or children proposes to acquire any property and the proposed acquisition is inconsistent with the provisions of the code of conduct prescribed in General Order 153, the acquisition thereof shall not be made without the officer having first obtained the permission in writing from the State Secretary.

(4) In deciding whether or not to grant permission under paragraph (3), the State Secretary shall have regard to the following:

(a) the size, amount or value of the holding, investment, house, land or property in relation to the officer's official emoluments and any legitimate private means;

(b) whether the acquisition or holding thereof will or is likely to conflict with the interests of the public service, or be inconsistent with the officer’s position as a public servant, or be in any way inconsistent with the provisions of the code of conduct prescribed in General Order 153;

(c) the opinion of the Head of Department as to the acquisition or ownership of the property; and

(d) any other factor which the State Secretary may consider necessary for upholding the integrity and efficiency of the public service.

(5) The nature, extent and value of the investment, house, land or other property which may be acquired or owned by the officer may be determined by the State Secretary from time to time and stipulated in Circulars to be issued by him.


(6) For the purpose of this General Order, "property" means any movable or immovable property, and includes property of any description as may be prescribed by the State Secretary from time to time.
