THE STATE PUBLIC SERVICE GENERAL ORDERS, 1996

(Made under section 3)


In exercise of the powers conferred by section 3 of the State Public Service (Conditions of Service) Ordinance, 1994, the Yang di-Pertua Negeri has made the following General Orders:

CHAPTER I

QUALIFICATIONS FOR APPOINTMENTS,
PROMOTIONS AND TERMINATION OF SERVICE

PART ONE

PRELIMINARY


1.-(1) These General Orders may be cited as the State Public Service General Orders, 1996, and shall come into force on the 1st day of January, 1996.

(2) Subject to section 1(3) of the Principal Ordinance and paragraph (3), these General Orders shall apply to every public officer in the public service of the State, except in so far as-

(a) the contrary intention is expressly provided for in these General Orders; or

(b) the person is excluded by the terms of his employment from the operation of these General Orders.

(3) These General Orders shall not apply to-

(a) the holder of any office specified in Article 44(2)(a) of the Constitution;

(b) unless the Majlis Mesyuarat Kerajaan Negeri otherwise direct, a member of any council, board, body, panel, committee or other similar body (whether incorporated or not) established by or under any written law;

(c) political secretaries;

(d) officers in the general public service of the Federation; or

(e) such other persons as the Yang di-Pertua Negeri may, by notification in the Gazette, exclude from the operation of these General Orders.

(4) These General Orders shall be read in conjunction with the Public Service Commission Rules, 1996.

(5) It shall be the responsibility of all public officers to acquaint themselves with all the provisions of these General Orders and the Public Service Commission Rules, 1996, and to comply therewith.
