Conditions for confirmation
27.-(1) Unless the appointment of an officer is terminated or his probationary period is extended, he should be confirmed in his appointment if the Head of Department is satisfied that the service of the officer is satisfactory after he has-

(a) completed the period of probation;

(b) successfully followed an Induction Course;

(c) passed any of the compulsory public service examinations prescribed under these General Orders; and

(d) fulfilled all other conditions in the scheme of service.

(2) The Head of Department shall submit a confidential report three months before the expiration of the period of probation to the State Secretary, who shall forward, in cases where the confirmation of appointment is dealt with by the Commission, the report together with his recommendation to the Commission in Form B of the Sixth Schedule.

(3) In submitting the confidential report, the Head of Department shall make a firm recommendation-

(a) that the officer be confirmed in his appointment;

(b) that the period of probation of the officer be extended;

(c) that the services of the officer be terminated; or

(d) that the officer shall revert to his former post.

(4) If the Commission, or the State Secretary where the powers of confirmation is delegated to him, is satisfied that the service of an officer on probation has been satisfactory, the Commission or the State Secretary, as the case may be, shall confirm his appointment with effect from the date of expiry of his probationary period. If the Commission or the State Secretary, as the case may be, is not satisfied that the service of an officer on probation has been satisfactory, the Commission or the State Secretary, as the case may be, may extend the period of probation for a further period or, in the case of an officer on first appointment, terminate his appointment forthwith.

(5) The officer shall be so informed if either his probationary period is extended or his appointment is confirmed or his service is terminated through his Head of Department.

(6) Pursuant to section 6a of the Pensions Act 1980, an officer appointed on or after 12th April, 1991 shall, before being confirmed in his appointment, be eligible to opt either for the pension scheme established under the Act or for the Employees Provident Fund Scheme in Form C of the Sixth Schedule.

(7) A confidential report of the Head of Department under paragraph (2) shall not be seen by the officer on probation, but any adverse comments on his work shall be notified in writing to the officer in specific terms as early as possible, so that he should have sufficient time in which to make an effort to correct his short-comings before his period of probation expires.

(8) The period of probation of an officer may be extended in the first instance for a period of not more than twelve months. The Head of Department shall, three months before the expiration of the extended period, report to the Commission through the State Secretary his recommendation as to whether the appointment of the officer should be confirmed or whether a further period of probationary service is necessary or whether the officer should not remain in the service. The Commission or the State Secretary, as the case may be, may at its or his discretion extend the probationary period for a further period not exceeding twelve months as it or he deems fit.
