Rates, terms and conditions of payments.
102.-(1) The rate of payment which an officer is eligible for in respect of transfer grant or house-moving allowance, as the case may be, as prescribed in General Order 101 is set out in the Eleventh Schedule.

(2) The terms and conditions for claiming such transfer grant are as follows:

(a) the claim for this payment shall be made in Form E of the Sixth Schedule;

(b) no expenses, additional payment or facility is eligible to be claimed relating to the transfer, such as expenses for transporting personal effects to another place;

(c) the officer is eligible to claim for expenses of transporting his motor vehicle supported by receipts in addition to the claim for payment of transfer grant when on transfer to a place not linked by roads within the State;

(d) the claim for transfer grant made before the transfer by way of Personal Advance may be paid by the Department or Agency from where the officer is transferred. For such Personal Advance claim, only the elements of transfer grant, commuted allowance and hotel room charges shall be taken into account. Such claim shall thereafter be adjusted to the actual claim made, and the balance may be paid by the Department or Agency to which the officer is transferred. Any claim made after the transfer shall be paid by the Department or Agency to which the officer is transferred, with a copy of the claim to be submitted to his former Department or Agency;

(e) an officer on transfer without bringing his family along is eligible to claim for such payment first at the rate for a bachelor. When the family of the officer follows later, the officer is eligible to claim for the balance, that is, the difference between the family rate and the bachelor rate. If an officer and his spouse are Government servants, either of them is eligible to claim for payment based on the rate of eligibility of the officer or of the spouse, whichever is higher;

(f) an officer who is on transfer outside the station as prescribed in General Order 101(a) means an officer on transfer, moving into and occupying the house in the new station, and is eligible to claim for transfer grant. The officer on transfer outside the station but not moving into and occupying the house in the new station is only eligible to claim for conveyance and mileage allowances for himself according to his eligibility under rules relating to official duty;

(g) notwithstanding the foregoing provisions, an officer who is on transfer within a station is not eligible to claim for such payment;

(h) the transportation of personal effects by ship shall be made only with shipping agencies approved by the State Secretary;

(i) any claim for commuted allowance shall be at such rates as set out in Table III of the Eighth Schedule for a period of three days before and five days after the transfer, according to the actual number of family members who follow. The officer is not required to submit any receipt/bill/invoice for such claim;

(j) any claim involving accommodation shall be at such rates as set out in Table II of the Eighth Schedule for hotel room charges in Sarawak for a period of three days before and five days after the transfer, according to the actual number of family members who follow: Provided that the maximum number of rooms shall not exceed three, whether they are family or single rooms. Where family rooms are occupied, the officer may, other than being eligible to claim for the actual rate of hotel room charges, make additional claim at the rate of 25% of the prescribed hotel room charges. The officer is required to submit the receipt/bill/ invoice for such claims. Where no hotel room charges are claimed, the officer is eligible to claim for lodging allowance (without receipts) for himself only at such rates as set out in Table II of the Eighth Schedule for a period of three days before and five days after the transfer;

(k) for transportation of goods by land, the claim for freight charges is made according to the actual distance at such rates as set out in Table III of the Eleventh Schedule. The claim for transport charges of goods other than by land requires the officer to submit receipt/bill/invoice. Actual claim supported by receipt/bill/invoice for journeys by sea is subject to the following capacity:

(i) (A) 1.84 cubic metres per person, in respect of officer and his spouse;

(B) 0.93 cubic metre per person, in respect of children three years and above and a servant; and

(C) 0.45 cubic metre per person, in respect of children under three years;

(ii) in addition to subsubparagraph (i) above, an officer is also eligible to claim for transport charges of goods according to the capacity as follows:

(A) 6.79 cubic metres in respect of married officer; and

(B) 3.39 cubic metres in respect of single officer;

(l) wherever in any receipt/bill/invoice there is noted therein the cost of the transportation of goods including the elements of packing, labour charges, storage fees, insurance and other related expenses required to be borne by the officer for arranging and securing the safety of his personal effects, the officer is not eligible to claim for transfer grant;

(m) any claim for passage by an officer may be made according to the actual distance based on his eligibility to claim for conveyance or mileage allowance for himself according to his eligibility under rules relating to official duty, as the case may be;

(n) the Department or Agency may provide or arrange for vehicle in transporting his personal effects and vehicle for use in travelling by the officer and his family. If such facility is provided or arranged by the Government, the officer is not eligible to claim for allowances and payment in respect of such same facilities;

(o) the transfer claim shall be made within one year from the effective date of the transfer order;

(p) an officer who is permitted to be transferred at his own request is only eligible to claim for such allowances as set out in Table IV of the Eleventh Schedule.

(3) The terms and conditions for claiming such house-moving allowance are as follows:

(a) the claim for this payment shall be made in Form F of the Sixth Schedule;

(b) the claim is subject to the condition that the officer occupies the said house;

(c) if the house-moving does not involve transport expenses, for example, the house-moving between blocks in the same complex, the officer is eligible to claim for half of the full payment. Similarly, if the facility for the transportation of personal effects is provided, the officer is only eligible to claim for half of the full payment. For house-moving between floors in the same block, the officer is not eligible to claim for any such allowance; and

(d) he claim for house-moving allowance shall be submitted to the Head of Department within a period of not later than three months after the date the house-moving is effected, failing which the application shall not be considered.
